1. General Terms

These Terms and Conditions govern your reservation and stay at Samanea Wellness Resort ("the Resort," "we," "us," or "our"), located in the Cardamom Mountains Area, Ou Saom Commune, Veal Veaeng District, Pursat Province, Kingdom of Cambodia. By making a reservation or staying at the Resort, you ("Guest," "you," or "your") agree to be bound by these Terms and Conditions.

2. Reservations and Bookings

2.1 Booking Confirmation

All reservations are subject to availability and confirmation by the Resort. A reservation is confirmed only upon receipt of the required deposit and written confirmation from the Resort.

2.2 Seasonal Definitions

Samanea Wellness Resort operates with three seasonal periods:

•Low Season: 1 May 2026 – 31 October 2026

•High Season: 1 January 2026 – 30 April 2026 and 1 November 2026 – 20 December 2026

•Peak Season: 21 December 2026 – 4 January 2027

2.3 Deposit Requirements

Deposit requirements vary by season:

Low Season (1 May 2026 – 31 October 2026)

•50% deposit required at time of booking

•Remaining 50% balance due 3 days prior to arrival

High Season (1 January 2026 – 30 April 2026 and 1 November 2026 – 20 December 2026)

•50% deposit required at time of booking

•Remaining 50% balance due 14 days prior to arrival

Peak Season (21 December 2026 – 4 January 2027)

•50% deposit required at time of booking

•Remaining 50% balance due 30 days prior to arrival

2.4 Payment Methods

We accept payment via:

•International credit cards (Visa, Mastercard, American Express)

•Bank transfer (details provided upon booking confirmation)

•Payment processing fees may apply for certain methods

2.5 Pricing

•All rates are quoted in USD unless otherwise stated

•Rates are subject to change until a deposit is received and booking is confirmed

•Rates include service charge and applicable taxes unless otherwise specified

•Additional government taxes or levies may be added if mandated by Cambodian authorities

3. Cancellation and Modification Policy

3.1 Cancellation by Guest

Cancellation policies vary by season. All cancellations must be submitted in writing to reservation@samanea-wellnessresort.com

Low Season  (1 May 2026 – 31 October 2026)

•Cancellation 7 days or more prior to arrival: No charge, full refund of any deposits

•Cancellation 6 to 4 days prior to arrival: 50% of total stay will be charged

•Cancellation 3 days or less prior to arrival: 100% of total stay will be charged

High Season (1 January 2026 – 30 April 2026 and 1 November 2026 – 20 December 2026)

•Cancellation 30 days or more prior to arrival: No charge, full refund of any deposits

•Cancellation 29 to 15 days prior to arrival: 50% of total stay will be charged

•Cancellation 14 days or less prior to arrival: 100% of total stay will be charged

Peak Season (21 December 2026 – 4 January 2027)

•Cancellation 60 days or more prior to arrival: No charge, full refund of any deposits

•Cancellation 59 to 31 days prior to arrival: 50% of total stay will be charged

•Cancellation 30 days or less prior to arrival: 100% of total stay will be charged

Important Note: Due to the resort's exclusive location and limited number of villas, every cancellation has a significant impact. This policy ensures we maintain our commitment to exceptional guest service and sustainability.

3.2 Modification of Reservations

•Changes to confirmed reservations are subject to availability

•Date changes are treated as cancellations and rebookings, subject to the cancellation policy of the original booking season

•Name changes and minor modifications (dietary requirements, spa bookings) can be made without penalty up to 7 days before arrival

3.3 No-Shows

Guests who fail to arrive on their scheduled check-in date without prior cancellation will be charged the full reservation amount with no refund.

3.4 Early Departure

No refunds will be provided for early departures or unused portions of the reservation.

3.5 Cancellation by the Resort

The Resort reserves the right to cancel reservations due to force majeure, natural disasters, government restrictions, or other circumstances beyond our control. In such cases, a full refund will be provided, but the Resort is not liable for any additional costs incurred by the Guest.

4. Check-In and Check-Out

4.1 Check-In Time

Standard check-in time is 2:00 PM. Early check-in is subject to availability and may incur additional charges.

4.2 Check-Out Time

Standard check-out time is 12:00 PM (noon). Late check-out is subject to availability and may incur additional charges.

4.3 Identification Requirements

All guests must present valid government-issued photo identification and a credit card upon check-in.

4.4 Age Requirements

Guests must be at least 18 years of age to check in. Guests under 18 must be accompanied by a parent or legal guardian.

5. Guest Conduct and Resort Rules

5.1 Respectful Behavior

Guests are expected to conduct themselves in a respectful manner toward other guests, staff, and the natural environment. The Resort reserves the right to ask any guest to leave immediately without refund if their behavior is deemed disruptive, dangerous, or inappropriate.

5.2 Prohibited Activities

The following activities are strictly prohibited on Resort premises:

•Smoking in non-designated areas (the Resort is predominantly smoke-free)

•Use of illegal drugs or substances

•Possession of weapons or firearms

•Disturbing wildlife or removing plants from the property

•Littering or environmental damage

5.3 Wellness Environment

Samanea is a wellness-focused resort. We kindly request that guests:

•Maintain a peaceful atmosphere

•Respect quiet hours (10:00 PM - 7:00 AM)

•Refrain from excessive alcohol consumption in public areas

6. Liability and Assumption of Risk

6.1 Personal Belongings

The Resort is not responsible for loss, theft, or damage to personal belongings. Guests are advised to use in-villa safes for valuables.

6.2 Wellness Activities

Participation in wellness activities, spa treatments, fitness classes, and outdoor excursions is at the Guest's own risk. Guests should inform staff of any medical conditions, injuries, or physical limitations prior to participation.

6.3 Medical Emergencies

While the Resort has basic medical facilities and trained staff, we are located in a remote area. Guests are strongly advised to obtain comprehensive travel and medical insurance. The Resort is not liable for medical expenses or evacuation costs.

6.4 Natural Environment

The Resort is situated within a pristine rainforest environment. Guests acknowledge the presence of wildlife and natural terrain. The Resort takes reasonable precautions for guest safety but is not liable for injuries resulting from interaction with wildlife, insects, or natural features.

6.5 Limitation of Liability

To the fullest extent permitted by law, the Resort's liability for any claim arising from your stay is limited to the total amount paid for your reservation.

7. Children and Minors

7.1 Age Policy

Children of all ages are welcome at Samanea Wellness Resort. However, certain wellness programs, spa treatments, and activities may have age restrictions for safety reasons.

7.2 Parental Supervision

Parents and guardians are responsible for supervising their children at all times, particularly around water features, pools, and natural areas.

8. Spa and Wellness Services

8.1 Advance Booking

Spa treatments and wellness programs should be booked in advance to ensure availability.

8.2 Cancellation of Spa Services

•Spa treatments cancelled less than 4 hours before the scheduled time will be charged at 50%

•No-shows will be charged at 100%

8.3 Health Disclosure

Guests must disclose any health conditions, allergies, or injuries to spa therapists prior to treatment.

9. Dining and Food Services

9.1 Dietary Requirements

The Resort accommodates dietary restrictions and allergies with advance notice. Please inform us at the time of booking.

9.2 Outside Food and Beverages

Outside food and beverages are not permitted in Resort dining areas.

10. Sustainability and Environmental Responsibility

10.1 Single-Use Plastics

In line with our sustainability commitment, single-use plastics are not provided.

10.2 Waste Management

Guests are encouraged to participate in our waste segregation program. Staff will provide guidance on proper disposal.

10.3 Environmental Respect

Guests are expected to respect the natural environment and refrain from activities that may harm the ecosystem.

11. Force Majeure

The Resort is not liable for failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to: natural disasters, extreme weather, government actions, civil unrest, pandemics, or infrastructure failures.

12. Privacy and Data Protection

Personal information collected during the booking process is handled in accordance with our Privacy Policy. By making a reservation, you consent to the collection and use of your data as described in our Privacy Policy.

13. Intellectual Property

All content on the Samanea Wellness Resort website, including text, images, logos, and design, is the property of the Resort or its licensors and is protected by copyright and trademark laws. Unauthorized use is prohibited.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms and Conditions are governed by the laws of the Kingdom of Cambodia.

14.2 Dispute Resolution

Any disputes arising from these Terms and Conditions or your stay at the Resort shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to arbitration in Phnom Penh, Cambodia, in accordance with Cambodian arbitration laws.

15. Amendments

The Resort reserves the right to amend these Terms and Conditions at any time. Updated terms will be posted on our website with the effective date. Continued use of our services after amendments constitutes acceptance of the revised terms.
